Executive Order 62: NY's Data Center Pause Goes Live

On July 14, 2026, Governor Kathy Hochul signed Executive Order 62, enacting the first statewide data center moratorium in the United States. The order directs the Department of Environmental Conservation (DEC) to hold in abeyance any discretionary permit for a data center that had not been deemed “complete” before that date, while the Department of Public Service (DPS) develops a Generic Environmental Impact Statement (GEIS) to set consistent, long-term standards for hyperscale development.

For anyone scoping low-voltage work on a New York data center project — structured cabling, fiber optic backbones, DAS, access control, CCTV — the order reshapes the near-term market in ways that matter operationally. Here is what the EO actually does, what it does not do, and where the work still is right now.

What Executive Order 62 Pauses — and What It Leaves Alone

The moratorium is narrower than the headlines suggest. Three parameters define its reach:

  1. 50 MW threshold. Construction Dive reports the order applies to data center projects that consume 50 megawatts or more and still require a DEC discretionary permit. That is a higher bar than the legislature’s earlier bill (S10642/A11560), which targeted facilities at 20 MW and above and, per Reuters, has not yet been sent to the Governor’s desk. The EO is the live policy; the bill is a separate, still-pending track.
  2. DEC discretionary permits only. The order’s text is explicit: it does not apply to “permits, approvals, licenses, or similar forms of permission from local governments.” Local planning-board approvals, site-plan reviews, and municipal permits continue on their own timelines.
  3. Grandfathering. Applications the DEC had already deemed “complete” before July 14 are not stalled. As Construction Dive notes, “data centers that have received all necessary permits will not be stalled.”

The practical effect: new hyperscale projects that still needed a DEC permit are paused until DPS submits its final GEIS and findings statement. Everything else — already-permitted builds, sub-50 MW facilities, and projects with only local approvals in hand — keeps moving.

The 12 GW Backlog Behind the Pause

The EO’s recitals include the number that explains why the state acted: nearly 12 gigawatts of data center load requests sat in the New York Independent System Operator (NYISO) interconnection queue as of May 2026, with more than 8 GW entering the queue in 2025 alone. That is accelerating demand the state’s aging grid and SEQRA framework were not built to absorb at this speed.

DPS is directed to run a formal public process — comment and hearing — to build the GEIS, assessing energy demand, water use and quality, air quality, disproportionate impacts on disadvantaged communities, and noise. Empire State Development (ESD) has 60 days to post a Community Investment Framework guiding host communities on negotiating local benefits like energy affordability programs, broadband, and labor participation.

Already-Approved NY Builds Keep Building

Because the grandfather clause protects projects deemed complete before July 14, the major NY data center builds already in motion are unaffected — and that is where the near-term low-voltage demand concentrates:

  • Micron’s Clay megafab (Onondaga County) poured first concrete in early July, moving to vertical construction roughly four months ahead of schedule. A four-fab, $250B+ campus at that scale is a multi-year Division 27/28 workload — structured cabling, fiber backbone, security, and AV across millions of square feet.
  • NYDIG’s Massena expansion (St. Lawrence County) entered formal town pre-submission review in June — two data halls, roughly 1.1 million sq ft, 635 MW of hydro power. That is the North Country’s largest private project, and it is advancing under local approvals untouched by the EO.
  • Western NY campuses (Niagara Falls, the Capital Region) continue conversion and buildout work at sub-threshold or already-permitted scales.

These projects need crews now. The moratorium pauses the next wave, not the current one.

What It Means for Low-Voltage Trades

The demand signal splits into two phases:

Phase 1 — Now through GEIS completion (est. ~12 months): Grandfathered and locally-approved builds accelerate as developers lock in status. Cabling, fiber, DAS, access control, and CCTV scopes on these jobs are live and staffing up. The same trades on not-yet-permitted hyperscale jobs shift to design, load calculations, and BOM work so scopes are shovel-ready the day DEC approvals resume.

Phase 2 — Post-GEIS: The 12 GW interconnection backlog does not disappear; it compresses. When the pause lifts, a surge of permitted projects will hit the construction pipeline roughly simultaneously, and the crews who kept design warm during the freeze will be the ones who can execute. Facilities that waited will compete for the same structured cabling and fiber resources at once.

A Note on the Contractor Pushback

The moratorium drew sharp industry criticism. Mike Elmendorf, president and CEO of Associated General Contractors of New York State, told Construction Dive the order “effectively slams the door on those projects” and “sends a hell of a message” to investors considering New York. Carlo Scissura of the New York Building Congress called it a move that “will damage our state’s economy, its workforce, and our competitive standing.” Brian Sampson of ABC’s Empire State Chapter framed it as “the wrong message at the wrong time.”

That debate is real, but for crews scoping work it is downstream of the operational reality: the EO is signed, the DEC pause is live, and the grandfathered pipeline is the pipeline that pays right now.

How to Sequence Your Scope

If you manage a New York data center project — as a GC, facility manager, IT director, or owner — the practical steps are straightforward:

  1. Confirm grandfather status in writing. Anything the DEC deemed complete before July 14 should continue. Verify with the agency rather than assuming.
  2. Check local approvals separately. The EO does not touch municipal permits. A project with local site-plan approval but a pending DEC permit is in a different position than one with neither.
  3. Keep design warm on paused jobs. Load calculations, cabling layouts, fiber routing, DAS coverage modeling, and security zoning can all advance during the freeze so the build is shovel-ready when permits resume.
  4. Watch the GEIS and the pending bill. The legislature’s 20 MW bill, if eventually signed, would widen the pause to smaller facilities. Track both tracks before committing long-lead labor.
